General Terms and Conditions (GTC)
1. Scope of Application
The following General Terms and Conditions apply to all orders placed through our online store.
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with TecPoint GmbH. By listing products in the online store, we are making a binding offer to conclude a contract for these items. You may initially add our products to your shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided for this purpose and explained during the ordering process. By clicking the order button, you accept the offer for the goods contained in the shopping cart. Immediately after submitting your order, you will receive an order confirmation via email.
3. Contract Language, Storage of Contract Text
The language available for concluding the contract is German. The website is also available in English. Order details can be accessed via your customer account, but the contract text itself is not stored separately.
4. Shipping Terms
Shipping costs are added to the listed product prices. You can find more details about the shipping costs in the product listings.
4.1. Shipping Costs in Case of Non-Delivery or Failure to Pick Up
(1) The buyer is responsible for shipping costs if the ordered package cannot be delivered due to an incomplete or incorrect delivery address or is not picked up from the package pickup location within the specified time frame. (2) After the goods are shipped, the buyer will receive a tracking number. The buyer is obligated to verify the accuracy and completeness of the provided delivery address and to correct it if necessary. (3) If delivery fails due to an incorrect or incomplete address provided by the buyer or due to failure to pick up the package at the package shop, the package will be returned to the seller. In this case, the buyer is responsible for the shipping costs incurred by the return.
5. Payment
The following payment methods are available in our store: credit card (Visa, MasterCard, American Express), Maestro, PayPal, Apple Pay, Google Pay, Klarna, MobilePay, Shop Pay, Union Pay, Bancontact, BLIK
6. Retention of Title
The goods remain our property until full payment has been received.
8. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies. The above limitations and shortened time limits do not apply to claims arising from damages caused by us, our legal representatives, or our vicarious agents:
- in the event of injury to life, limb, or health,
- in the event of intentional or grossly negligent breach of duty, as well as fraud,
- in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations),
- within the scope of a warranty, if agreed upon, or
- to the extent that the Product Liability Act applies. Information regarding any additional warranties that may apply and their specific terms and conditions can be found with each product and on dedicated information pages in the online store.
9. Liability
We are always liable without limitation for claims arising from damages caused by us, our legal representatives, or our vicarious agents:
- in the event of injury to life, limb, or health,
- in the event of intentional or grossly negligent breach of duty,
- in the event of warranty promises, to the extent agreed upon, or
- to the extent that the scope of application of the Product Liability Act applies. In the event of a breach of essential contractual obligations—the fulfillment of which is essential for the proper performance of the contract and on whose compliance the contracting party may regularly rely (cardinal obligations)—due to slight negligence on our part, on the part of our legal representatives, or on the part of our vicarious agents, liability is limited in amount to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected. In all other respects, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform, which you can find at https://ec.europa.eu/consumers/odr/ We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
